Filing For Divorce?

The decision may be the right one, but filing for divorce can throw an individual’s or a family’s life into chaos. Even if the decision is mutual and both parties are willing to resolve their issues at the negotiating table instead of in court, dissolving a marital partnership still takes hard work and patience, particularly when there are children involved.

At Northern Valley Law, we regularly help individuals and their families through this process. We work with our clients to determine the approach that best serves the needs and goals of the family. We try to make this difficult process go as smooth as possible, while still creating fair and binding agreements. If this is not possible, our attorneys’ extensive success in court means we will effectively fight to ensure that your rights are protected to the fullest extent of the law.

Legal Issues To Consider When Filing For Divorce

There are countless decisions with far-ranging impact upon the lives of you and your family. The important ones include:

  • Contested or uncontested divorce: Contested means expensive court costs and a longer process, but sometimes it is necessary. Uncontested is collaborative and strikes a more positive note for the entire family to move forward.
  • Child support and custody plan: Often the most important issue for parents, the goal of custody should be determining a plan that is workable for everyone whenever possible. This also includes important issues like health coverage, the changing needs of the children and planning for their future.
  • Dividing marital assets: Assets (and debt) accumulated during the marriage are divided in an equitable manner that is not the same as half-and-half. It will be more complicated if there is a business or large portfolio of assets.
  • Property division: Virginia is an equitable distribution state, which means that marital assets are split fairly but not half-and-half.
